What role do I play in a Personal Injury or Medical Negligence case?
We often get asked, ‘Will I have an active role during the lifetime of a claim for compensation arising from personal injury or medical negligence?’ In this blog, we will outline your roles and responsibilities throughout the lifetime of your case.

It is essential that the person bringing the claim (or their parent if they are a minor) is involved throughout a claim. Although this may sound burdensome and difficult to juggle alongside your other day-to-day commitments, it is vital for achieving the best result in a claim.
Although solicitors have the legal knowledge to assist you with a claim, the majority of the factual information, in most cases, comes directly from the injured person or a litigation friend assisting an injured person.
It is useful if a diary is kept of the events immediately after an accident/episode of medical negligence and during the recovery period. The diary should include any medical treatment you receive, your physical and psychological symptoms, any help you receive from friends/family, or paid help which you wouldn’t have had if you hadn’t been injured and time off work. This diary will assist your solicitor who will use the information and their legal knowledge to present the best possible case to the party at fault.
Your involvement in the case is crucial as your solicitor cannot make decisions on your behalf. Instructions must come from you, unless you are unable to provide instructions, in which case someone will be appointed to act as your litigation friend.
