How much could it cost to file a Medical Negligence claim?

All professionals train for many years to provide their services to a high standard. But no one is infallible and mistakes are made from time to time. In the case of medical professionals, their mistakes can have far reaching consequences for patients who are the victims of their negligence.

If you are injured by a medical professional, you might consider bringing a claim against whoever is responsible for your injuries but then be put off by the potential cost of bringing such a claim.

Legal advice isn’t “free” nor are the medical experts who you would need to help you prove your case. Medical negligence claims can take years to conclude and the cost can run into hundreds of thousands of pounds.

However, most firms practising in medical negligence litigation will offer to engage in a Conditional Fee Agreement (CFA) with you. You might be familiar with the term “no win no fee” which is essentially what a CFA is.

How does a CFA work?

Your case will be risk assessed. If after the risk assessment we consider that your case has good prospects of success, we may investigate your case further under a CFA.

Who pays my legal fees?

If we enter into a CFA with you, we will only be paid of the case is successful. The losing party (hospital or doctor’s insurers) will be liable for our fees, court costs incurred and the fees of any barrister we instruct. If you lose your case, we don’t get paid. This is why risk assessment is so important throughout the case.

Who pays the experts?

There are agencies who will meet the ongoing fees of the experts instructed. We will also arrange After the Event Insurance (ATE). If the case is successful, the losing party will pay the expert’s fees. If the case is abandoned or lost, then the ATE policy will respond and pay the expert’s fees to the agency concerned.

Will you have to pay anything?

Yes, but only if your claim is successful and you receive compensation. There will always be a risk that your claim is unsuccessful and we won’t get paid.

So, if your case is successful, we will deduct a relatively small proportion of your compensation to reflect the risk we have taken in pursuing your claim, this is called a success fee. You would also have to pay a proportion of the insurance premium if your claim is successful.
