Compensation awarded to Mrs MD after hospital breach of duty

Medical Negligence Claim for surgical error

An error during surgery at a hospital left Mrs MD seeking compensation and so, she asked Osborne Morris & Morgan to help her with her case. 

In 2014, Mrs MD instructed OM&M following surgery to her left forearm in 2013. The purpose of the surgery was to remove a benign lipoma (lump). The operation notes confirmed that all nerves, arteries and tendons were in tact during and following surgery.

Within days Mrs MD complained of a loss of sensation in her hand and went on to develop debilitating pain in her forearm as well as numbness in her hand, which was later diagnosed as Complex Regional Pain Syndrome (‘CRPS’).

OM&M investigated the case on behalf of Mrs MD and ascertained that there was no mention in the operating note of the superficial sensory branch of the radial nerve and steps should have been taken by the surgeon to identify and protect the sensory nerve. Failure to do so was a breach of duty. The Defendant conceded liability.

Mrs MD, who continued with chronic pain in her left hand/forearm, was unable to return to her part time work, and needed assistance with certain household tasks. Her claim settled and Mrs MD was awarded £360,000 in compensation.
