Everyone should consider making a Will that offers theopportunity to look after your family in as straightforward and tax efficient a way as possible. This may involve provision for a partner, appointment of guardians for your children or safeguarding the future of your business. A well drafted will takes into account your concerns and seeks to anticipate and resolve potential problem areas.

Wills Trusts and Probate

Your Will is probably the most important document you will sign. You therefore need OMM’s expert advice to ensure that it meets your wishes.

If you would like to make a will, telephone Melanie Williams to discuss your requirements. For routine wills we offer a fixed fee of £200 + Vat for an individual will and £350 + Vat for spouses or partners where the terms of the wills are similar.

 

Trusts

A trust is a legal arrangement in which a person transfers assets to trustees to look after on behalf of one or more beneficiaries. Trusts remain useful in a range of situations including provision for children and vulnerable adults. OMM specialise in the setting up and arrangement of trusts to organise your financial affairs flexibly and tax efficiently.

As well as managing and administering trusts for our catastrophically injured clients who are unable to manage their own affairs, OMM are able to provide a specialist service to those clients who need trusts for specific financial reasons. OMM can also act as your trustee if you so wish.

OMM’s trust department offer a comprehensive service to individuals who have recovered compensation. Many personal injury and clinical negligence claimants are in receipt of state means tested benefits which receive special treatment under government legislation. A carefully drafted trust can enable you to keep all or the majority of your benefits even though you have received a substantial award, where the financial contribution from State funding can make a critical difference to your long term financial future.

OMM are pleased to act for claimants whose awards have been handled by other firms who do not have the benefit of a specialist trust department.

 

Probate

The administration of an estate is a service OMM can provide when sympathy and support are necessary. OMM will provide a personal and caring service to ensure that the wishes of your loved one are administered efficiently and as quickly as possible.

 

Lasting Powers of Attorney (LPA)

When you make a Will it is also as important to make an LPA. A property and affairs LPA is a document that will enable a family friend or relative to look after your financial affairs in the event of your mental incapacity being impaired by an accident or illness. A personal welfare LPA can also be made which enables a person to make decisions regarding your welfare.

If you do not have an LPA and you then suffer an accident or illness impairing you mentally, OMM can make application to the COP so that your financial affairs can be efficiently dealt with. However, as this is a slow and sometimes frustrating process, making of an LPA with a will is the best course of action you can take.
